SECTION 1 – ACCESS AND ACCOUNT

You must be at least the age of majority in your state or province of residence to use the Services.

You agree to provide accurate, current, and complete purchase and account information. You are responsible for maintaining the confidentiality of your account credentials and for all activity occurring under your account.

Accounts may not be transferred, sold, or assigned.

SECTION 2 – PRODUCTS AND PRODUCTION

We strive to display product colors, dimensions, and details as accurately as possible. However, screen settings, lighting, and device differences may affect how products appear.

Made-to-Order Items

Many items are produced individually or in small batches. Minor variations in trimming, color density, mounting, paper texture, or finishing are inherent to the process and are not considered defects.

Expressive Artwork

Some products may contain political, social, protest-related, or expressive content. Customers are responsible for determining whether the display or use of any product complies with local laws, property rules, or organizational policies.

We reserve the right to limit quantities, discontinue products, or modify product descriptions at any time.

SECTION 3 – ORDERS

All orders constitute an offer to purchase. We may accept or decline any order at our discretion, including where safety, legal, or misuse concerns arise.

Payment must be received before an order is accepted. Once production has begun, cancellations may not be possible.

Because many items are made to order, refunds or exchanges are limited except in cases of confirmed production defects.

Customer-Provided Artwork

If you submit designs or artwork for printing, you represent that you own or have permission to use all submitted materials. You agree to indemnify ICE OUT OF MPLS against any claims related to copyright, trademark, or intellectual property infringement arising from such submissions.

Purchases are intended for personal use unless otherwise agreed in writing.

SECTION 4 – PRICES AND BILLING

Prices and promotions may change without notice. Posted prices do not include taxes or shipping unless stated.

You agree to provide valid payment information and authorize charges incurred at the time of purchase.

SECTION 5 – SHIPPING AND DELIVERY

Delivery times are estimates and are not guaranteed. We are not responsible for delays caused by carriers, weather, customs processing, or events beyond our control.

Risk of loss transfers to you once the shipment is delivered to the carrier.

We are not responsible for lost or stolen packages after delivery confirmation.

Shipping damage claims must be reported within 5 days of delivery.

SECTION 6 – INTELLECTUAL PROPERTY

All artwork, graphics, text, product designs, branding, and site content are the property of ICE OUT OF MPLS or its licensors and are protected by copyright and trademark laws.

Purchase of physical artwork does not grant reproduction, licensing, merchandising, or commercial display rights unless expressly agreed in writing.

You may not reproduce, scan, distribute, digitize, or commercially exploit any product or content without prior written permission.

SECTION 7 – OPTIONAL THIRD-PARTY TOOLS

We may provide access to third-party tools “as is” without warranties. Use of such tools is at your own risk.

SECTION 8 – THIRD-PARTY LINKS

We are not responsible for third-party websites or services linked through the Services.

SECTION 9 – SHOPIFY RELATIONSHIP

Transactions are solely between you and ICE OUT OF MPLS. Shopify is not responsible for any products, services, or damages related to your purchases.

SECTION 10 – PRIVACY

Your submission of personal information through the store is governed by our Privacy Policy.

SECTION 11 – FEEDBACK

By submitting comments, suggestions, or other feedback, you grant us the right to use such feedback without restriction or compensation.

SECTION 12 – ERRORS AND OMISSIONS

We reserve the right to correct pricing or description errors and cancel affected orders.

SECTION 13 – PROHIBITED USE

You may not use the Services for unlawful, harmful, or abusive purposes, or to violate intellectual property rights.

Automated scraping, misuse of security features, or transmission of malware is prohibited.

SECTION 14 – AGENT ACCESS

Autonomous software agents must identify themselves and comply with all access restrictions. We may limit or block agent access at any time.

SECTION 15 – TERMINATION

We may terminate access to the Services at our discretion. Provisions relating to intellectual property, liability limitations, and indemnification survive termination.

SECTION 16 – DISCLAIMER OF WARRANTIES

Services and products are provided “as is” without warranties of any kind, to the fullest extent permitted by law.

SECTION 17 – LIMITATION OF LIABILITY

ICE OUT OF MPLS shall not be liable for indirect, incidental, or consequential damages arising from use of the Services or purchased products.

SECTION 18 – INDEMNIFICATION

You agree to indemnify ICE OUT OF MPLS against claims arising from your breach of these Terms or misuse of the Services.

SECTION 19 – SEVERABILITY

If any provision is found unenforceable, the remaining provisions remain in effect.

SECTION 20 – ENTIRE AGREEMENT

These Terms constitute the entire agreement between you and ICE OUT OF MPLS regarding the Services.

SECTION 21 – ASSIGNMENT

You may not assign your rights without our written consent. We may assign these Terms at our discretion.

SECTION 22 – GOVERNING LAW

These Terms are governed by the laws of the State of Minnesota, United States.

Any disputes shall be resolved in the state or federal courts located in Minnesota.

SECTION 23 – FORCE MAJEURE

We are not liable for delays or failure to perform caused by events beyond our control, including equipment failure, supply shortages, weather events, labor disruptions, or government actions.

SECTION 24 – CHANGES TO TERMS

We may update these Terms at any time by posting changes on the website. Continued use of the Services constitutes acceptance of the revised Terms.
